GENERAL AND COMMERICAL TERMS <(>&<)> CONDITIONS FOR HIRING OF HEAVY EQUIPMENTS. Date: 1. Prices to be inclusive of all charges including operator / driver charges +Reliver + Repairs <(>&<)> Maintenance crew + Insurance + RTO + Consumables (like fuel oil etc.) +fuel filling facility (like bowser, pick up, etc.) at site + Safety PPE. 2. Vendors must quote basic prices. GST shall be paid extra as applicable. 3. All operators / drivers to be deployed on shift wise duty basis. Vendor to ensure duty hrs not to exceed beyond shift hours as applicable from HSE rules of AMNS India. 4. Equipment manufacturing year must be 2018 or later (Equipment of manufacturing year before 2018 will not be allowed) and it should be in good working condition. Any decision regarding acceptance of equipment of YOM earlier than 2018 will be taken by AMNS only in exceptional cases. 5. Payment shall be made as per quantity certification provided by AMNS India user department. 6. Payment shall be made within 30 days of invoice submission. 7. Equipment should be ready to deploy / make operational at our site by 1st Jan 2025. However, the exact date of mobilization would be communicated 7 days in advance. 8. Final vehicle check will be done by AMNS HSE department, and all PPEs shall be in vendor’s scope. Equipment fitness <(>&<)> PPEs will be checked every month by AMNS India user department. The contractor shall provide the equipment and operator as per land of law (e.g., RTO Laws <(>&<)> Fitness) and company policies (e.g., Safety Certification <(>&<)> Competency Training). 2. The contractor should provide the required number of relievers for safe operation. No operators will be permitted to work beyond 12 hrs and must be given weekly off. Continuous duty of more than 9 days is not allowed. 3. Penalties will be applicable for violating safety/statutory norms, mobile policy/vehicle driving policy as per AMNS consequence management policy. 4. The contractor must ensure safe transport of their operator and maintenance team inside plant premises. No Pedestrian/Cycles/Two Wheelers movement will be allowed inside the Plant Premises. 5. In Case of Any Property Damage Penalty AS Per Consequent Management of AMNS Policy Imposed and Vendor have to Repair/Replace Damage Property or Pay Amount of Damage as per Assessment by Competent person. 26. Vendor must ensure to give proper numbering of deployed dumper at MH department (for example: vendor name/MH/Sr No.) 27. Vendor must ensure proper auto lock system in dumping gate of dumper for each dumper deployed at MH department. 28. Penalty as per bill amount of respective month will be imposed if dumper fleet goes below 80% of required dumpers fleet. (80 to 70 % - 5 % penalty of bill amount, 70 to 60 % - 10 % penalty of bill amount, below 60 % - 20 % penalty of bill amount) 29. Movement of Manpower / Associates at our Hazira Site. 1. No Pedestrian/Cycles/Two Wheelers movement will be allowed inside the Plant Premises. 2. Vendor must ensure availability of sufficient buses/vehicles to ply their associates inside plant premises. Vendors to ensure safe transportation of their associates from their place of residence to respective work location in the plant and back. The movement of persons inside the plant by foot/bicycle/two wheelers is prohibited. Other Terms: Associate must undergo Medical Fitness at our Care Nursing Home, AM/NS Township, Hazira. This would be done as per AM/NS India standards and the cost shall be borne by the vendor. (Refer Annexure 1 for maximum allowable load inside plant premises) b) If load is exceeding maximum allowable load, AMNS user department will consider only max allowable load in invoice bill generation (example: If max allowable load for any dumper is 30MT, and its weighment is showing 31MT, then only 30MT will be considered for invoice generation) 33.
